About PetPulse

PetPulse is a service operated by Nick Thomas as a sole proprietorship ("PetPulse," "I," "me," or "my"). These Terms of Service ("Terms") govern your use of the PetPulse application and related services (collectively, "the Service").

Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years of age to use PetPulse. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have parental or guardian consent.

Account Registration and Security

To use PetPulse, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify me immediately of any unauthorized access or security breach
• Accept responsibility for all activity that occurs under your account

I reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use and Prohibited Conduct

You agree to use PetPulse only for lawful purposes. You must not:

• Use the Service to harm, harass, or defraud others
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Upload or transmit viruses, malware, or malicious code
• Scrape, crawl, or data-mine the Service without prior written permission
• Use the Service in any way that violates applicable law or regulation

Pet Care Data

PetPulse allows you to record daily routines, medication, and health information for your pets. You are solely responsible for:

• The accuracy of pet, routine, and medication data you enter
• Verifying medication dosages and schedules with a licensed veterinarian
• All decisions made based on information stored in the Service

PetPulse is not a substitute for professional veterinary advice. I am not liable for harm arising from reliance on information stored in the Service.

SMS Messaging Terms

If you provide a phone number and opt in to SMS reminders, the following terms apply:

• Program description: PetPulse sends SMS messages related to pet care routines, medication schedules, supply alerts, and caregiver coordination.
• Consent is voluntary: Opting in to SMS is not a condition of using PetPulse. You may use the Service with email reminders only.
• Message frequency: Frequency varies based on the routines and notification preferences you configure.
• Message and data rates: Standard message and data rates may apply, depending on your mobile carrier and plan.
• Opt-out: Reply STOP at any time to any PetPulse SMS message to unsubscribe. After you opt out, you will receive one final confirmation message and no further SMS messages unless you opt in again.
• Help: Reply HELP to any PetPulse SMS message for assistance, or contact [email protected].
• Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.
• Privacy: Mobile information and SMS opt-in data are not shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy for details.

Intellectual Property

The Service and its original content, features, and functionality are and will remain my exclusive property and that of my licensors. You may not copy, modify, distribute, sell, or lease any part of the Service without prior written consent.

You retain ownership of the content you upload to the Service. By uploading content, you grant me a limited, non-exclusive license to use it solely to provide the Service to you.

Third-Party Services

PetPulse may integrate with or link to third-party services, including SMS delivery via Twilio. I am not responsible for the content, privacy practices, or terms of those services. Your use of third-party services is governed by their respective terms and policies.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. I DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NICK THOMAS, OPERATING AS PETPULSE, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless Nick Thomas, operating as PetPulse, from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, USA, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in Washington for the resolution of disputes.

Changes to These Terms

I reserve the right to modify these Terms at any time. I will notify you of material changes by updating the effective date above and, where appropriate, by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
